This application has been filed seeking to condone the delay of 21 days in filing the written statement by the defendant. 2.In the affidavit filed in support of the Judges Summons, it had been contended that notice had been served on the counsel on 09.06.2025. But however, the applicant could not come over to Chennai to give necessary instruction to prepare the written statement. In the process there has been a delay of 21 days in filing the written statement.
3.Heard the learned counsel for the plaintiffs. 4.It would only be appropriate that the Will which is sought to be propounded is proved in the presence of all parties and taking that view into consideration, the delay is condoned and the written statement of the defendant is taken on record.
