ORDER
This Criminal Original petition has been filed seeking to direct the second respondent to alter the first information report in Crime No.23 of 2023 dated 10.7.2023 and add Section 376 of the Indian Penal Code and the relevant provisions of the Income Tax Act in the above FIR on the basis of complaint dated 10.7.2023.
2. The learned Additional Public Prosecutor, on instructions, would submit that the first information report was registered only on 10.7.2023 for an offence under Section 417 of the Indian Penal Code, that the investigation is in progress and that if, in the course of investigation, the second respondent collects sufficient materials, the offenses will be altered accordingly.
3. In view of the above submission, there shall be a direction to the second respondent to continue with the investigation effectively and based on the materials collected during the course of investigation, either alter the first information report or file the final report by adding the necessary offences made out.
