O R D E R
This petition has been filed to set aside the order passed by the Special Judge under the Tamil Nadu Protection of Interest of Depositors in Financial Establishment Act, 1997, Chennai and relax the condition that the petitioner is directed to appear before the Investigation Officer daily at 10.30a.m., until further orders imposed in Crl.M.P.No.2609 of 2024 dated 24.10.2024 by the Special Judge under the Tamil Nadu Protection of Interest of Depositors in Financial Establishment Act, 1997, Chennai.

The learned counsel for the petitioner submitted that the petitioner was granted statutory bail by the Special Court No.II for Trial of Criminal Cases related to Elected MP's and MLAs of Tamil Nadu, Special Court under TNPID ACT (FAC), Chennai in Crl.M.P.No.2609 of 2024 in Crime No.11 of 2024 on 24.10.2024 with a condition that the petitioner shall appear before the respondent police on everyday at 10.30a.m., until further orders. He would further submits that he is 56 years old and suffers from serious medical issues such as high blood pressure, due to which he requires immediate medical attention on a daily basis. He has to take care of the petitioner's ailing father, whose heart is functioning at only 30%. Being the sole breadwinner, he has to earn money not only to meet his daily needs but also to repay his creditors. Hence, due to the above mentioned 2/4
circumstances, he is not in a position to comply with the condition imposed by this Court, as he is unable to carry out his day to day activities. Hence, he seeks for modification of the above said condition.

Considering the submission made by the learned counsel appearing for the petitioner, the condition imposed as against the petitioner is modified to the effect that the condition in Para (6) "that the petitioner is directed to appear before the respondent Police on second and fourth Tuesday on every month at 10.30a.m., until further orders. The other conditions shall remain intact.
