ORDER

Pursuant to the earlier order passed by this Court, dated 11.09.2023, the matter was referred to mediation. The parties were able to arrive at a settlement and they have signed the settlement agreement, dated 14.09.2023. Accordingly, the mediation report has also been sent to this Court. 1/3

2. On going through the settlement agreement, it is seen that the petitioner has compromised to pay the amount that is due and payable in installments. The respondent has agreed to receive a sum of Rs.8,00,000/-. On payment of the sum of Rs.8,00,000/-, the respondent has agreed to waive the balance amount of Rs.8,00,000/-.

3. In the light of the above development, the offence is compounded under Section 147 of the Negotiable Instruments Act, 1881. It is made clear that if the petitioner fails to comply with the condition stipulated in the settlement agreement, it is left open to the respondent to file an appropriate application before this Court seeking for the revival of the proceedings.
