This Criminal Original Petition has been filed seeking to enlarge the petitioner on bail in the Crime No.213 of 2022 registered for the offence punishable under Sections 341, 294(b), 324 & 307 IPC on the file of the respondent Police.
2. The case of the prosecution is that due to the previous enmity, the petitioner along with the other accused abused the brother of the defacto complainant in a filthy words and assaulted him indiscriminately with knife, due to which, he sustained grievous injuries all over the body. Hence the complaint.
3. The learned counsel for the petitioner would submit that the this is the second bail application before this Court and this Court by an order dated 26.09.2022 had dismissed the bail application in
Crl.O.P.No.23056 of 2022, stating that the injured has not been discharged from the hospital. He would further submit that the petitioner is in custody from 06.09.2022 and he is prepared to abide by any stringent condition imposed by this Court and thereby, he prays for grant of bail to the petitioner.

Per contra, the learned Government Advocate (Crl.Side) appearing for the respondent would submit that the petitioner along with the other accused, due to the previous enmity, waylaid the brother of the de-facto complainant and abused him in a filthy words and assaulted him indiscriminately with knife, due to which, he sustained grievous injuries all over the body and he is still taking treatment in the Stanley Hospital, Chennai. Hence, he vehemently oppose for grant of bail to the petitioner.
5. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) and perused the materials available on record.
6. Taking into consideration the facts and the submissions made by the learned Govt. Advocate (Crl.Side) that the injured has been taking treatment still and he has also been referred for speciality treatment, this Court is not inclined to grant bail to the petitioner.
7. Accordingly, these Criminal Original Petitions stands dismissed.
