The petitioner, who is the sole accused, was arrested and remanded to judicial custody on 19.02.2016 for an alleged offence punishable under Section 302 of IPC in Crime No.42 of 2016 on the file of the respondent police and hence, seeks bail.

2.The case of the prosecution is that the petitioner was married to a driver and out of the wedlock, they are having two children, son aged about 10 years and daughter aged about 7 years and due to long standing property dispute between the husband of the petitioner and the brothers, there was a wordy altercation. While so, on 17.02.2016, due to the dispute, the petitioner got frustrated and she thrown her son into the well and while she was attempted to throw her daughter, the de facto complainant, who is the mother of the petitioner came there and rescued her. The petitioner also attempted to commit suicide and she was rescued with some injuries. 3.Learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and she has not committed any offence as alleged by the prosecution. It is further submitted that the deceased died due to accidentally and the petitioner has been implicated as an accused in this case.

sri 4.Per contra, learned Government Advocate [Criminal Side] appearing for the respondent would submit that the petitioner was not happy with the family life and attempted to commit suicide as well as to murder her two children.

5.Considering the above facts and circumstances of the case, this Court is inclined to grant bail to the petitioner with certain conditions. 6.Accordingly, the petitioner is ordered to be released on bail on her executing a bond for Rs.10,000/- [Rupees Ten Thousand only] with two sureties each for a like sum, to the satisfaction of the learned Judicial Magistrate, Gingee and on further condition that the petitioner shall report before the respondent police daily at 10.00a.m. until further orders. 22.03.2016 sri Crl.O.P.No.6368 of 2016
