Respondents PRAYER : Writ Petition has been filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents 1 to 4 to survey the land in cart track based on the proceedings of the 3rd respondent dated 10.01.2011 made in Na.Ka.No.17817/10/A3 and the representation of the petitioner dated 21.01.2016 in respect of the properties comprised in Survey No.6/2C1, 6/2B, 6/1B and 1A2 situate at Moppiripatti Village, Harur Taluk, Dharmapuri District.

By consent, the Writ Petition is taken up for disposal at the stage of admission itself.

2. This Writ Petition has been filed to issue a Writ of Mandamus directing the respondents 1 to 4 to survey the land in cart track based on the proceedings of the 3rd respondent dated 10.01.2011 made in Na.Ka.No.17817/10/A3 and the representation of the petitioner dated 21.01.2016 in respect of the properties comprised in Survey No.6/2C1, 6/2B, 6/1B and 1A2 situate at Moppiripatti Village, Harur Taluk, Dharmapuri District.

3. Though several grounds have been raised in the Writ Petition, now, the learned counsel for the petitioner would only seek to consider the representation dated 21.01.2016.

4. Mr.Digvijaypandian, learned Additional Government Pleader takes notice for the respondents and would submit that the request of the petitioner will be considered in accordance with law.

5. Considering the submissions made on either side and taking note of the averment made by the learned counsel for the petitioner that there is no civil case is pending, this Court, without going into the merits of the claim made by the petitioner, directs the 3rd respondent, to consider the representation of the petitioner dated 21.01.2016 and pass appropriate orders, on merits and in accordance with law as expeditiously as possible after giving notice to the respondents 5 to 8. It is made clear that this Court has not expressed any opinion with regard to the merits of the claim made by the petitioner.
