O R D E R
This writ petition has been filed seeking issuance of a writ of mandamus directing the second respondent to consider the representation made by the petitioner wherein the petitioner has sought for review and revocation of the suspension order issued by the second respondent dated 14.06.2023.
2. Heard Mr.S.Doraisamy, learned counsel for petitioner and Mr.G.Velu, learned Additional Government Pleader appearing for respondents.
3. The case of the petitioner is that he was appointed on compassionate grounds as Village Administrative Officer in the year 2011. A First Information Report came to be registered by the Directorate of Vigilance and Anti-Corruption, Thiruvarur District, in Crime No.3 of 2023 under Section 7 of the Prevention of Corruption Act. The petitioner was arrested and remanded to judicial custody. 2/4
4. The second respondent, through proceedings dated 14.06.2023, passed an order of suspension against the petitioner under Rule 17(2)(e) of the Tamil Nadu Civil Services (Discipline and Appeal) Rules. The petitioner was subsequently released on bail by this Court by order dated 07.07.2023.
5. The petitioner was kept under continued suspension and therefore, the petitioner made two representations dated 20.05.2024 and 01.07.2024 requesting for review and revocation of the suspension order. Since the same were not considered, the present writ petition has been filed before this Court.
6. Taking into consideration the facts and circumstances of the case and the nature of relief sought for by the petitioner, there shall be a direction to the second respondent to consider the representation dated 01.07.2024 made by the petitioner on its own merits and in accordance with law and pass appropriate orders within a period of six (6) weeks from the date of receipt of a copy of this order. 3/4
