The petitioner, who was arrested and remanded to judicial custody on 08.09.2022, for the offences punishable under Sections 147, 148, 307, 332 of IPC, in Crime No.285 of 2022, on the file of the respondent police, seek bail.

2. The case of the prosecution as per the defacto complainant is that in order to wreak vengeance, the petitioner had waylaid the police Escort vehicle when the victim was transported to the Court and they have also assaulted the police personnel. The overt act attributed as against the petitioner is that the petitioner has threatened the police when the police had attempted to safeguard the victim. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this

case. He would also submit that other than being present at the scene of occurrence, the petitioner has not committed any offence as alleged by the prosecution. Therefore, he prays for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent would submit that in order to wreak vengeance on the victim, the petitioner had waylaid the police escort vehicle when the victim was taken to the Court. He would also submit that the petitioner had assaulted the policemen and also threatened the police in public view. Therefore, he vehemently opposed for grant of bail to the petitioner.

5. Heard both the learned Counsel and perused the materials available on record.

6. Taking into consideration the facts and circumstances of the case

and the submission made by the learned counsel and also the manner in which the offence is committed, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this Criminal Original Petition stands dismissed for the present.
