By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. 2.The present Writ Petition is filed for issuance of a writ of Certiorarified 1/4
Mandamus, challenging the refusal slip dated 24.02.2025, whereby petitioner's sale deed was refused registration on the premise that no documents were produced before the respondent viz., the parent document, patta and other revenue document to indicate that the petitioner has title over the subject property.
3.Learned counsel for the petitioner would submit that the refusal check slip has been issued without affording her any opportunity to demonstrate with documents as to how she has valid title over the subject property. 4.At this juncture, learned Special Government Pleader would submit that the petitioner may submit her response for the reason assigned in the refusal check slip, and if any such response is filed along with the documentary evidences, the same would be considered and sale deed would be registered, if the same is otherwise in order, after affording opportunity of hearing to the petitioner. If for any reason the sale deed is refused registration, they would do so after assigning reasons, which was agreed to by the learned counsel for petitioner.
5. In view thereof, the impugned refusal slip dated 24.02.2025 is set aside 2/4
and the writ petition stands disposed of. It is open to the petitioner to submit her response for the reason assigned in the refusal check slip, and if any such responses are being submitted by the petitioner along with the documentary evidences, the respondent shall consider the same and register the sale deed, if the same is in order, after affording opportunity of hearing to the petitioner. If for any reason the registering authority finds that the registration ought to be refused, the same shall be done after assigning appropriate reasons and after putting the petitioner and other interested parties, if any, on notice. It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the respondent to consider the matter on its own merits and in accordance with law.
