A.Nos.4756, 4758 and 4760 of 2023 in TOS No.17 of 2014 A.A.NAKKIRAN, J.

These three applications have been filed by the applicants/plaintiffs i) to condone the delay of 581 days in filing the set aside application on abatement of 1st plaintiff, ii) to set aside the abatement caused due to the death of the 1st plaintiff herein in the above Testamentary Original Suit and iii) to bring on record the applicants 2 and 3 as legal heirs of the 1st plaintiff viz., T.S.Narasiman who died on 31.08.2021 and array them as plaintiffs 3 and 4 in the above TOS.

2. The learned counsel for the respondents/defendants has no objection to allow these three applications.

3. Being satisfied with the reasons stated in the affidavits filed in support of the applications, these three applications are allowed.

4. Learned counsel for the plaintiffs is directed to carry out necessary amendment.
