ORDER

The petitioner herein filed instant application seeking to modify the direction issued by this Court in W.P.No. 36937 of 2024 directing the respondents 1 and 2 to complete the recovery proceedings as per the recovery warrant issued by Tamil Nadu Real Estate Regulatory Authority in EP.No.18/2024 in RCP.No.61 of 2022 within a period of twelve weeks from the date of receipt of copy of that order.

2. Since the direction issued by this Court in the impugned writ petition has not been complied with by the respondents 1 and 2, the petitioner herein initiated the contempt proceedings. It is stated in the affidavit filed in support of the petition subsequent to the filing of the contempt petition that the third respondent in W.M.P.No.3914 of 2026 approached the petitioner and a compromise deed was entered into between the petitioner and the third respondent on 11.12.2025. It is further stated that in lieu of the amount payable to the petitioner, the 3rd respondent executed a sale deed on 12-01-2026 in respect of the property described therein conveying the same to the petitioner.

3. In view of the settlement, the petitioner further prayed this court to accept the settlement reached between the petitioner and the third respondent and modify the earlier order passed by this court as recovery of the amount from the third respondent is no more necessary.

4. In view of the settlement reached between the petitioner and the third respondent with regard to the amount payable by third respondent to the petitioner, the order passed by this court directing the respondents 1 and 2 to recover the amount mentioned in the recovery warrant need not be executed. Recording the averments made by the petitioner in WMP.No.3914 of 2026, the contempt petition is closed and WMP.No.3914 of 2026 is ordered by recording statement of the petitioner. No costs.
