Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to relax the condition that the petitioner shall appear before the Judicial Magistrate, Additional Mahila Court, Salem on the first working day of every month at 10.30 a.m. Crl.M.P.No.144/2018 in Crl.R.C.No.17/2017 order dated 05/01/2017.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.R.NALLIYAPPAN, Advocate for the petitioner and of MR.M.MOHAMED RIYAZ, ADDITIONAL PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- The above petition is filed seeking to relax the condition imposed by this Court on the petitioner/A-1 vide order dated 05.01.2019 made in Crl.MP.No.144/2018 in Crl.RC.No.17/2017. The learned counsel for the petitioner would submit that this Court, in its order dated 05.01.2019 had suspended the sentence imposed on the petitioner till 05.01.2017 with a direction to report before the Judicial Magistrate, Additional Mahila Court, Salem at 10.30 a.m., on the first working day of every English Calendar Month pending appeal and would seek modification that the condition of appearing before the Trial Court on the first working day of every month, be modified.

Heard Both sides.

Taking into consideration the submission made by the learned counsel for the petitioner, the condition imposed vide order dated 05.01.2017 is hereby modified and the petitioner shall appear before the Trial Court once in three months commencing from the first working day of October 2019, pending revision. https://hcservices.ecourts.gov.in/hcservices/
