The petitioner, who was arrested and remanded to judicial custody on 10.09.2022, for the offences punishable under Sections 294(b), 323, 307 and 506(ii) of IPC, in Crime No.184 of 2022, on the file of the respondent police, seek bail.

2. The case of the prosecution is that due to a quarrel, the petitioner along with the other accused had indiscriminately assaulted the defacto complainant with knife, due to which he sustained injuries. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and since, he happens to be the fried of the other accused, he has been implicated in this case. He would also submit that the injured has been discharged from the Government hospital as per the lower Court order. Therefore, he prays for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) appearing for the respondent would submit that during a quarrel, the petitioner along with his brother, had indiscriminately assaulted the victim, resulting in him sustaining grievous injuries. He would also submit that the injuries on the victim are very grievious in nature and after the injured has been discharged from the Government hospital, he is admitted in CMC Hospital, Vellore for further treatment. He would further submit that the petitioner has got one previous case of similar nature. Therefore, he vehemently opposed for grant of bail to the petitioner.

5. Heard both the learned Counsel and perused the materials available on record.

6. Taking into consideration the facts and circumstances of the case and the submission made by the learned counsel and also the fact that the injured is still in hospital and that the petitioner has got one previous

case of similar nature, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this Criminal Original Petition stands dismissed for the present.
