This petition is listed today under the caption 'for being mentioned' at the instance of the learned counsel for the petitioner. 2.The learned counsel for the petitioner submitted that the appeal challenging the order of the Tahsildar denying the petitioner with the legal heir certificate was preferred sometime in February, 2023, and not on 01.08.2023 as has been mentioned in the order dated, 26.09.2023, and the petitioner has preferred a representation dated 01.08.2023 inter alia for an expeditious hearing and disposal of the said appeal. The learned counsel submitted that the order has not captured this idea with clarity. 3.This Court perused the papers and is satisfied that the petitioner is right and the Court is wrong.
4.Paragraph no.1 of the order dated 26.09.2023 is rephrased as below; "The petitioner has been denied a legal heir certificate, challenging which, he has preferred an appeal in February, 1/3
2023 and for an expeditious disposal of the same, he has preferred a representation dated 01.08.2023"
5.Paragraph no.3 of the said order is rephrased as below; "This Court now requires the respondent to hold an enquiry into the appeal filed by the petitioner in February 2023, after giving due opportunity of hearing to all those who are likely to be affected by his decision and conclude his enquiry within a period of eight (8) weeks from the date of receipt of a copy of this order."
6.The Registry is now directed to carry out the necessary corrections and host the corrected copy in the official website and issue the corrected certified copy of the order dated 26.09.2023 to the petitioner. 09.10.2023 Tsg 2/3
