This Court while disposing of the above said Civil Revision Petitions on 26.05.2022 directed the trial Court to dispose of the case in C.C.No.5 of 2019 preferably within a period of four months.

2. Today, when the matter came up for hearing, it was brought to the notice of this Court by the Registry that the learned XII Additional Special Judge for CBI Cases (FAC) XIV Additional City Civil Court, Chennai through her letter in Dis.No.1069/2022 dated 04.11.2022 had requested this Court to grant further time for the disposal of the case in C.C.No.5 of 2019.

3. Learned Special Public Prosecutor appearing for the respondent Police submitted that in this case, there are totally 43 witnesses, of which, 9 witnesses have been examined and remaining 34 witnesses have to be examined. Further, the witnesses are from various parts of the country. The prosecution is taking all earnest steps to produce the witnesses when they are available. In fact, in this case the accused have not yet cross examined some of the witnesses.

4. The learned counsel for the petitioners fairly submitted that in this case, some of the witnesses yet to be cross examined. Further, gave an undertaking that as and when witnesses are produced, they shall cross examine the witnesses and they will not be a reason for any delay.

5. Finding the difficulty expressed by the trial Court and also the reasons given by the petitioners, this Court is inclined to grant further time.

6. Accordingly, the trial Court is directed to proceed with the case in C.C.No.5 of 2019 without any time frame, at the same time post the case periodically and endeavour to complete the trial within a specific period without further delay.
