Prayer: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorari to call for the records culminated in the impugned summons pertaining to case No.1343 lof 2025 dated 23.06.2025 pending on the file of the 1st respondent and quash the same. For Petitioner : Ms.Hemaa.S.

ORDER

(The order of the Court was made by J.Nisha Banu,J.) This writ petition has been filed challenging the impugned summons pertaining to case No.1343 of 2025 dated 23.06.2025 pending on the file of the 1st respondent.

2. The case of the petitioner is that she is a house wife. The 3rd respondent is her younger brother. The 3rd respondent had entered into business transactions with the 2nd respondent in the year 2015 relating to share trading. Following losses suffered by the 2nd respondent, civil litigation has been pending between the 2nd and 3rd respondents from the year 2015. The 2nd respondent has maliciously implicated the petitioner in a complaint that led to issuance of summons dated 23.06.2025 by the 1st respondent, stating that the 2nd respondent had lodged a complaint pertaining to cheating of money committed by the petitioner during the year 2016. The petitioner appeared before the 1st respondent on 30.06.2025 and denied any connection to the financial dispute. However, once again, the petitioner was asked to attend a second enquiry and was compelled to sign in blank papers. The 1st respondent has no jurisdiction to try the complaint. Hence, the above writ petition.

3. Heard the learned counsel for the petitioner and perused the

materials available on record.

4. On perusal of the records, it is seen that summons has been issued to the petitioner to attend the enquiry. Without attending the enquiry, she has come before this Court by way of this writ petition. Therefore, we are not inclined to entertain this writ petition. The Writ Petition is dismissed. No costs. Consequently, connected miscellaneous petition is closed.
