The petitioner who was arrested and remanded to judicial custody on 22.06.2022 for the offences punishable under Section 366(A) of IPC read with Sections 5(l) and 6 of POCSO Act, 2012 in Crime No.244 of 2022 on the file of the respondent police, seek bail.
2. The petitioner had filed a bail petition before this Court. Pending the bail petition, the petitioner also filed a bail petition before the Court below in Crl.M.P.No.1604 of 2022, suppressing the fact that the petitioner had already filed a bail petition before this Court. Therefore, the Court below considered the facts and granted bail to the petitioner, on 11.10.2022.
3. Now, the learned counsel for the petitioner seeks permission of this Court to withdraw the petition and he has also made an endorsement to that effect.
4. Since the petitioner had played fraud upon this Court, it should be permitted with cost.
5. In view of the submissions and endorsement made by the learned counsel for the petitioner, this Criminal Original Petition is dismissed as
withdrawn with the following condition that, "the petitioner is directed to pay a sum of Rs.10,000/- (Rupees Ten Thousand only) as cost to the Tamil Nadu State Legal Services Authority, Chennai, on or before 28.10.2022, failing which, the bail granted by the Court below to the petitioner in Crl.M.P.No.1604 of 2022 dated 11.10.2022, shall stand automatically cancelled and the respondent is at liberty to secure the petitioner and proceed in accordance with law". 18.10.2022 mn
