Respondents Prayer: Petition filed under Article 226 of the Constitution of India seeking issuance of a writ of Mandamus directing the respondents to

ORDER

(Order of the Court was made by the Hon'ble Acting Chief Justice) The petitioner seeks a directions to the respondents to shift TASMAC Shop No.8286 situated at National Highways Road, Nadugani, Pandalur, The Nilgiris District to some other remote place.

2. Learned Standing Counsel for the TASMAC submits that the petitioner has a remedy of appeal under Rule 9-A of the Tamil Nadu Liquor Retail Vending (In Shops and Bars) Rules, 2003 and without exhausting the same, the petitioner has approached this Court.

3. In view of the above, the respondents are directed to

communicate the copy of the permission granted to the said TASMAC shop, to the petitioner, within a period of two weeks from the date of receipt of a copy of this order and thereafter, the petitioner is permitted to challenge the same under Rule 9-A of the Rules within a period of three weeks.

4. The writ petition stands disposed of. There shall be no order as to costs.
