Respondent PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to modify the condition No.1 that he shall execute a bond for Rs.10,000/- with two acceptable and reliable sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Sriperumbudur. One among the sureties must be a blood surety, vide order dated 30.08.2023 in Crl.M.P.No.6261 of 2023 by the Principal Special Court under EC & NDPS Act Chennai.

ORDER

This Criminal Original Petition is filed to modify the condition No.1 that he shall execute a bond for Rs.10,000/- with two acceptable and reliable sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Sriperumbudur; One among the sureties must be a blood surety, vide order dated 30.08.2023, passed in Crl.M.P.No.6261 of 2023, by the Principal Special Court under EC & NDPS Act Chennai. 2.It is the submission of the learned counsel for the petitioner that while granting bail to the petitioner in Crl.M.P.No.6261 of 2023 on 30.08.2023, the following condition was imposed: that he shall execute a bond for Rs.10,000/- with two acceptable and reliable sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Sriperumbudur. One among the sureties must be a blood surety. He further submitted that petitioner is a foreign national he is not able to get a blood relative from his native country, who will stand as a surety for him. Thus, he wants to modify the condition imposed in Crl.M.P.No.6261 of 2023.

3.In the circumstances stated by the learned counsel for the petitioner, the condition that one among the sureties must be a blood surety is modified to the effect that both sureties should be acceptable and reliable sureties for executing the bond for a sum of Rs.10,000/- each to the satisfaction of the learned Judicial Magistrate, Sriperumbudur. Other conditions remains unaltered.
