Aaron Samuel Hospital Society v. Forest Range Officer
W.M.P. No.27041 of 2019 in W.P. No.6791 of 2008 T.RAJA,J.
The petition has been filed to condone the delay of 186 days in re-presenting the petition in W.M.P. SR.12986 of 2019 in W.P. No.6791 of 2008.
2.Learned counsel appearing for the petitioner would submit that there is also another petition seeking to condone the delay of 12 days in fling the petition to restore the dismissal for non prosecution and the same has not been numbered.
3.This Court is not able to find any justification to entertain the petition. The reason being that when the writ petition was dismissed for non prosecution, the petitioner has not moved the restoration petition within 30 days time which shows that he is not vigilant enough to prosecute the case. There is a delay in filing restoration application and again there is a delay of 186 days in representing the said application, therefore, I do not find any sufficient cause, hence, it is dismissed.
