Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to relax the condition imposed upon me that I should appear before the Trial Court once in Three months in Crl.M.P.No.2215 of 2019 Crl.M.P.No.18484 of 2019 in Crl.A.No.872 of 2019 in order dated 26.02.2019. Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.A.V.SOMASUNDARAM, Advocate for the petitioner, and of MR.K.SRINIVASAN, Special Public Prosecutor for CBI-cases, on behalf of the Respondent, the court made the following order:- Earlier, this Court by an order dated 26.02.2021 in Crl.M.P.No.2215 of 2021 suspended the sentence with the condition that the petitioner shall report before the learned II Additional District Judge for CBI Cases, Coimbatore once in three months commencing from April 2021 on the first working day of every English calender month at 10.30 a.m.. Now, to relax the said condition, the present petition has been filed.
2. Today, when the matter taken up for hearing, Mr.A.V.Somasundaram, learned counsel appearing for petitioner would submit that, the petitioner is a lady and she is complying with the condition regularly for more than a year and due to ill-health, she find it difficult to comply with the condition once in three months. Hence, she sought for relaxation of condition.
3. Considering the facts and circumstances and also considering the fact that the petitioner is regularly complying with the condition imposed by this Court, this Court is inclined to modify the condition to the effect that the petitioner shall report before the learned II Additional District Judge for CBI Cases, Coimbatore once in six months, on the first working day of the month, at 10.30 a.m. starting from 01.03.2022 until further orders.
