Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to relax the condition imposed upon me that I should appear before the Respondent police once in Three months in Crl.M.P.No.4365 of 2021 in Crl.M.P.No.18486/2019 in Crl.A.No.873/2019 in order dated 30.04.2021. Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S. A.V.SOMASUNDARAM, Advocate for the petitioner, and of MR.K.SRINIVASAN, Special Public Prosecutor for CBI-cases, on behalf of the Respondent, the court made the following order:- Earlier, this Court by an order dated 12.12.2019 suspended the sentence with a condition that the petitioner shall appear once in a month before the learned II Additional District Judge for C.B.I. Cases, Coimbatore at 10.30 a.m until further orders. Subsequently, this Court by an order dated 30.04.2021 modified the condition that the petitioner shall appear before the trial court once in three months.
2. It is submitted by learned counsel appearing for petitioner that the petitioner is complying the condition regularly. Now, due to his ailments and age, the doctor advised him to take complete bed rest and not to travel even for a short distance in order to avoid further infection. Hence, he is not in a position to appear before the learned II Additional District Judge for C.B.I. Cases, Coimbatore and he finds it difficult to appear before the trial Court. Therefore, the petitioner has filed this petition to relax the condition.
3. Considering the fact that already this court modified the condition that the petitioner shall appear before the trial court once in three months, no further modification is required at this stage.
