Crl.O.P.No.20874 of 2023 G.CHANDRASEKHARAN.J., The petitioner namely Sethuraman, who was arrested and remanded to judicial custody on 21.07.2023 for the offences under Sections 147, 148, 294(b), 307, 324, 341, 506(ii) of IPC read with Section 25(1)(a) of Arms Act in Crime No.201 of 2023 on the file of the respondent police, seeks bail.

The learned counsel for the petitioner submitted that, petitioner is an innocent person and he is falsely implicated in a case registered in a case registered in Crime No.201 of 2023 for the offences under Sections 147, 148, 294(b), 307, 324, 341, 506(ii) of IPC read with Section 25(1)(a) of Arms Act. Petitioner's name is not mentioned in the FIR. Petitioner has applied for the post of Sub Inspector. Petitioner is in Judicial Custody from 21.07.2023. Thus, he seeks bail to the petitioner.

3. In response, learned Additional Public Prosecutor submitted that, defacto complainant is engaged in the business of renting lorry, JCB etc., and he is also involved in real estate business. First accused used to call him through cell phone and threatened him to pay money. 1/3

Defacto complainant questioned as to why he has to pay money and cut the phone call. Aggrieved over this, on 21.07.2023, when defacto complainant was cleaning lorry and JCB, accused persons had come there with deadly weapons and started attacking him. As a result, he suffered extensive injuries. In support of his submission, he produced the copies of the wound certificate and photo of the injured. He further submitted that, petitioner has one previous case registered in Crime No.258 of 2023 for the offence under Section 307 of IPC.

Considering the nature of the offence committed by the petitioner along with other accused and the nature of injuries suffered by the victim and he is still taking treatment in the hospital and that the investigation in this case is not completed, this Court is not inclined to grant bail to the petitioner.
