O R D E R

The petitioner herein apprehends arrest at the hands of the respondent police for offences punishable under Section 5 of Explosive Substance Act-1908 and 9(B)(1)(b) Indian Explosives Act,1884, in Crime No.312 of 2025, on the file of the respondent police, and therefore seeks anticipatory bail.

2. The case of the prosecution is that the first petitioner was found in possession of 824 gelatin stick and 550 detonators, which were being transported in a car without proper permission. During the enquiry, the first accused allegedly confessed before the respondent police that he had purchased those items from the present petitioner to sell them to persons engaged in quarrying operations. Hence, the present case has been registered.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case. He further submitted that the seized contraband does not belong to the petitioner and prayed for the grant of anticipatory bail.

4. The learned Government Advocate (Crl. Side) submitted that an analysis report has been received, which establishes a link between the seized contraband and the petitioner. He further submitted that the arrested persons have also stated that they collected the gelatin sticks from the petitioner. Hence, he strongly opposed the grant of anticipatory bail.

5. Considering the submissions made on either side and the fact that the petitioner has allegedly supplied a huge quantity of gelatin sticks, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition stands dismissed.
