2.Heard the learned counsel for the petitioner and the learned counsel for the 1st respondent.

3.Learned counsel for the 1st respondent does not have any serious objection in allowing this petition.

4. Despite receipt of notice and its name being printed in the cause list, there is no representation for the 2nd respondent / Insurance Company either in person or through counsel.

5. Being satisfied with the reasons stated in the affidavit filed in support of this petition, this Civil Miscellaneous Petition is ordered and the delay of 122 days in representing the above appeal is hereby condoned.
