PRAYER: Writ Petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the 4th respondent to issue the Natham Patta in New survey No 107/7 in (Old Survey No 141 A/3) village Natham in Natham, Survey No 377/1 in extent of 2190 Sq.Ft. in Pasur Village, Kodumudi Taluk, Erode District to the petitioner as per the petitioner purchase the sale deed in document No. 941 / 2005.

O R D E R

By consent of both the learned counsel appearing for the petitioner as well as respondents, this writ petition is disposed of at the admission stage itself.

2. The petitioner herein seeks a direction to 4th respondent to issue Natham patta in respect of land in New Survey No.107/7 (Old Survey No.141/A3, Natham Survey No.377/1 at Pasur Village, Kodumudi Taluk,

3. It is the case of the petitioner that he purchased the above mentioned property under registered sale deed dated 16.09.2005 and has been in his possession and enjoyment of the same. The petitioner submitted a representation on 06.01.2024 before the 1st respondent seeking issuance of 2/5

patta and the same has not been considered. Hence, he is before this Court.

4. The learned Special Government Pleader, who is taking notice for the respondents, submitted that the competent authority for considering the representation of the petitioner is the 3rd respondent and the representation would be considered on its' own merits within a time fixed by this Court.

5. In view of the same, without going into the merits of the claim made by the petitioner, the 1st respondent is directed to forward the representation of the petitioner dated 06.01.2024 to 3rd respondent within a period of two weeks from the date of receipt of copy of this order. The 3rd respondent shall consider the same and pass final orders on its' own merits within a further period of four weeks.

6. With the above directions, this writ petition is disposed of. No costs. 23.09.2024 Index : Yes/No nr 3/5
