( Civil Appellate Jurisdiction ) Monday, the Twenty Fourth day of August Two Thousand Twenty PRESENT THE HON`BLE MR JUSTICE R.MAHADEVAN CMP NO.20432 OF 2019 IN AS.NO.680 OF 2019 V.R.ARUL DEIVEEGAN [ PETITIONER ] Vs MUTHUKUMARAN [ RESPONDENT ] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to stay all the proceedings pursuant to the judgment and Decree dated 28.06.2019 made in O.S.No.195/2010 on the file of the Court of the III Additional District and Sessions Judge, Cuddalore alias Virudhachalam pending AS.No.680 of 2019.

Order : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.C.MUNUSAMY, Advocate for the petitioner and of Ms.R.MEENAL, Advocate for the respondent, the court made the following order:- O R D ER In this miscellaneous petition, on 09.12.2019, an order of interim stay was granted subject to condition that the petitioner should deposit a sum of Rs.10,00,000/-, on or before 03.01.2020. Subsequently, an extension petition came to be filed, which was entertained and time was granted till 10.02.2020 to comply with the conditional order earlier passed by this Court. However, it was specifically mentioned in the said order that if the petitioner fails to deposit the amount within the stipulated time, the interim stay granted would stand automatically vacated without any further reference to this Court.

2.Today, when the case was taken up for consideration, the learned counsel appearing for the respondent submitted that the petitioner has not complied with the aforesaid conditional order. https://hcservices.ecourts.gov.in/hcservices/
