The Application has been filed by the respondent in the Original Petition seeking a direction to send the petitioner in the Original Petition to ascertain her mental ability.

2. The very fact that the Original Petition is being contested by the petitioner in the Original Petition and she is taking steps to ensure that orders relating to the guardianship and custody are passed in her favour would itself shows that she is mentally capable for handling her affairs and also in handling the affairs of the child. Now the parties are directed to tender evidence. The application No. 4883 of 2023 stands closed.

3. The earlier arrangement indicated on 10.06.2024 for the respondent to have access to the child is maintained and the same can continue till disposal of the Original Petition. The application No. 5976 of 2023 stands closed.

4. Since the parties are directed to tender evidence, Application No.3383 of 2023 stands closed.

5. List the Original Petition before the learned Master for commencing recording of evidence on 13.08.2024. After recording of the evidence, the matter may be listed before this Court. 24.07.2024 Maya
