The application is filed by the sole defendant to appoint an Advocate Commissioner to record his evidence in C.A.No.239 of 2021. 2.
According to the applicant/defendant, he suffered Acute Ischemic Stroke and was admitted in the Dr.Kamakshi Memorial hospital as an in-patient on 04.05.2024. He was discharged from the hospital and was advised to take strict rest and avoid any movement. Hence he seeks for recording his evidence through Advocate Commissioner instead of appearing before the Master to give his deposition . 3.
Considering the medical record, this Court allow the application. In a connected suit, this Court appointed Mr. R.Shivakumar (Mobile No.98403 63686) No.6, 3rd Floor, The Southern India Chambers of Commerce and Industries Building, Esplanade, Chennai-600 104, as the Advocate Commissioner to record the evidence. Therefore, for the sake of 1/3
convenience, the same Advocate Commissioner is appointed to record the evidence. The Advocate Dr.G.JAYACHANDRAN, J.
rpl Commissioner shall fix the date for the examination of witnesses and inform the respective counsel atleast 7 days in advance. Thereafter, upon completing the recording the evidence file his report along with deposition on or before 06.01.2025.

A sum of Rs.25,000/- is fixed as the initial remuneration for the Advocate Commissioner and the said amount shall be paid directly to the Advocate Commissioner by the applicant/defendant. 5.
List the matter on 06.01.2025.
