The application has been filed seeking leave to institute the suit within the jurisdiction of this Court on the ground that the cheques have been issued at Chennai and that substantial cause of action had arisen within Chennai.

2. The property against which the relief is sought to be enforced is however outside the jurisdiction of this Court.

3. A Caveat is placed under Section 22 of the Specific Relief Act, 1877, that no relief of possession of the property can be argued at any point. The plaintiff will have to proceed on any other basis.

4. Holding that the plaintiff cannot include the relief of possession at a later date, the application stands allowed.

5. The Registry to number the suit if it is otherwise in order.
