The petitioners, who are arrayed as Accused, apprehend arrest at the hands of the respondent police for alleged offences punishable under Sections 366-A IPC and 6 of POSCO Act, in crime No.83 of 2016, on the file of the respondent police and hence, seek anticipatory bail.

2.The case of the prosecution is that the first accused had kidnapped the daughter of the defacto complainant, who is 17 years old, with the help of A2 to A5 and married her on 07.02.2016. 3.The learned counsel for the petitioners would submit that the defacto complainant is the mother of the alleged victim and the marriage was held on 07.02.2016 and subsequently, due to matrimonial dispute, she left her matrimonial home and with the help of the defacto complainant, alleged false complaint against the petitioners.

4.Heard the learned Government Advocate (Crl.side) appearing for the respondent.

5. Considering the facts and circumstances of the case and considering the nature of the allegation made against the petitioners, this court is constrained to grant anticipatory bail to the petitioners.

Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the Judicial Magistrate, Paramathi, Namakkal District and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners 1 & 5 shall appear before the respondent police daily at 10.00 a.m until further orders and the petitioners 2 to 4 shall appear before the respondent police as and when required for interrogation for a period of two weeks and thereafter, as and when required for interrogation. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy is made ready, failing which, the petition for anticipatory bail stands dismissed.
