(RC.NO.8/E/2008) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to relax the condition i.e. the petitioner shall appear before the trail court "once in three months on the first working day of every 3rd month at 10.30 a.m.," made in pending appeal vide Crl.M.P.No.5975 of 2020 in Crl.A.No.391/2020 order dated 02/10/2020.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.K.SHANKER, Advocate for the Appellant and of THE SPECIAL PUBLIC PROSECUTOR FOR CBI CASES on behalf of the Respondent the court made the following order:- Earlier, this Court by an order dated 02.10.2020 in Crl.M.P.No.5975 of 2020 suspended the sentence with the condition that the petitioner shall report before the learned XI Additional Sessions Judge (CBI Cases relating to Banks and Financial Institutions), Chennai once in three months on the first working day of every 3rd month at 10.30 a.m. until further orders. Now, to relax the said condition, the present petition has been filed.

2. Today, when the matter taken up for hearing, Mr. K.Shanker, learned counsel appearing for petitioner would submit that, the petitioner is a lady and she is complying with the condition regularly for more than a year and due to ill-health, she find it difficult to comply with the condition once in three months. Hence, she sought for relaxation of condition.

3. Considering the facts and circumstances and also considering the fact that the petitioner is regularly complying with the condition imposed by this Court, this Court is inclined to modify the condition to the effect that the petitioner shall report before the learned XI Additional Sessions Judge (CBI Cases relating to Banks and Financial Institutions), Chennai once in six months, on the first working day of the month, at 10.30 a.m. starting from 05.01.2022 until further orders.
