Habeas Corpus Petition filed under Article 226 of the Constitution of India, to issue a Writ of Habeas Corpus, directing the respondents to produce the petitioner's daughter Ms.Sophia, aged 19 years bodily in person before this Court and set her at liberty. O R D E R

(The Order of the Court was made by M. M.SUNDRESH,J.,) The petitioner is the father of the detenue. This habeas corpus petition has been filed on the ground that the detenue is in illegal custody.

2. The learned Additional Public Prosecutor appearing for the respondents submitted that the detenue infact appeared before the All Women Police Station, Pochampalli and made a statement that she has married her close relative by name Sabari. The factum of marriage was also known to the petitioner. It is further stated https://hcservices.ecourts.gov.in/hcservices/

that the detenue is a major. He has also produced a copy of the statement made and signed by the detenue dated 23.08.2019. He has also produced the evidence to show that the detenue married one Sabari, which is the marriage receipt issued by the temple authority for the marriage conducted in the temple.

3. We further note that the complaint was given by the petitioner before the second respondent whereas, the detenue appeared before the All Women Police Station, Pochampalli and made a statement to the knowledge of the petitioner.
