O R D E R

By consent of both the learned counsel for the parties, the Writ Petition is taken up for final disposal, at the admission stage itself.

The instant writ petition has been filed with a prayer for issuing a Mandamus, directing the respondent to pay the Petitioner the amount of Rs.14,182/- payable as wages towards 25 days of earned leave surrendered by him, while he was in service as admitted by the respondent in their RTI, together with 15% interest from the date of his retirement, and to pay him a sum of Rs.17,150/- he is entitled towards the STERBS (State Transport Employees Retirement Benefit Scheme) Contribution, which was deducted from his salary for every month, while he was in service, together with interest at the rate of 12% per annum, within a specified time as may be fixed by this Court.

3. Heard the learned counsel for both sides and perused the materials available on record.

The learned counsel for the petitioner would submit tha the petitioner has joined in the services of the Respondent-Transport Corporation as Conductor on 27.08.1986 and on attaining the age of superannuation, he retired from service on 31.03.2017 as Selection Grade Conductor. The learned counsel for the petitioner would submit that he has given representations to the respondent on 16.04.2025 and 16.06.2025 to claim surrendered earned leave amount and STERBS (State Transport Employees Retirement Benefit Scheme) Contribution and such representations are pending with the respondent. The learned counsel for the petitioner would further submit that the respondent has admitted their liability to the RTI query.

5. At this juncture, the learned Standing Counsel appearing for the respondent would submit that they will consider the petitioner's representations according to it's own merits and in accordance with law, within a reasonable time.

6. In such view of the submission, without going into the merits of the writ petition, this Court deems it appropriate to direct the respondent to 3/6

consider the petitioner's representations dated 16.04.2025 and 16.06.2025 and pass orders on it's own merits and in accordance with law, within a period of eight weeks from the date of receipt of copy of this order. It is made clear that if the petitioner is eligible for any amount, he is entitled for interest at the rate of 6% per annum from the date of retirement till the date of its disbursal.
