The present application has been filed to carry out the amendments to the plaint appended in the schedule to the Judges summons.

Mr.S.K.Bijai Sundar, learned counsel for appearing on behalf of the first defendant had filed a counter contending that the application is not maintainable and therefore would have to be dismissed. On the other hand, Mr.C.Vigneswaran, learned counsel appearing on behalf of the second defendant has no objection in allowing the present application.

3. Heard the learned counsels appearing for their respective parties.

4. The case of the applicant is that the third defendant in the Suit had settled part of the claim and had also undertaken to settle the entire claim of the applicant. Pursuant to the said settlement, the applicant has also taken out an application to strike of the third defendant from the array of parties and by order dated 09.01.2024, this Court had allowed the said application striking of the third defendant from the array of the parties and had also directed the applicant herein to make necessary amendment to the plaint. Pursuant to the said direction, the present application had been taken out for carrying out the amendments to the plaint. Therefore, I do not find any impediment in allowing the application as prayed for and in fine the Application is ordered as prayed for.
