O R D E R

This application has been filed seeking to fix a time frame for completion of evidence of PW2.

2. PW2 is in the witness box, but it had been stated that he had to go over to the USA for the death ceremonies of his brother.

3. The learned counsel for the plaintiff stated that the witness would be back to attend the court hearings on 19.08.2025 in the Court of the learned Additional Master No.III to subject himself for further cross-examination. The cross-examination of PW2 to continue again on 21.08.2025 and be completed by 22.08.2025.

4. The defendants have given two witnesses to whom they proposed to examine. The first witness viz., R.Vasu, D1 to be examined on 26.08.2025. DW1 to be present on 26.08.2025 and file his proof affidavit, but however it is seen that list of documents has also not been filed.

5. In spite of the order of the Hon'ble Supreme Court, which had been obtained on application filed by the defendant determining a time frame, the defendant has today produced only the list of witnesses and

has not yet produced the list of documents which they rely on and time is sought for that purpose.

6. The defendant has intention to drag on the matter. Hence, Application No.3602 of 2025 stands dismissed. 04.08.2025 Maya
