ORDER
The present writ petition has been filed with a prayer for mandamus, to direct the 1st and 2nd respondents to consider and pass orders on the proposal submitted to the 3rd respondent in Na.Ka.No.1650/Uoo/2023 dated 11.08.2023 within a stipulated time.
2. The learned counsel for the petitioner submits that the petitioner is currently serving as a Library Assistant and is eligible for promotion to the post of Librarian. In this regard, the 3rd respondent has already forwarded a proposal to the 2nd respondent on 11.08.2023 and such proposal is still pending consideration with the 2nd respondent.
3. At this juncture, the learned Government Advocate appearing on behalf of the respondents submits that according to the Service Rules, the post of Librarian is to be filled through exclusively direct recruitment by the TNPSC and the same does not fall within the scope of promotion. However, 2/5
the learned counsel fairly submits that if any proposal is received, it will be considered and disposed of by them in accordance with law.
4. I have given my anxious consideration to either side submissions and also perused the materials available on record.
5. In view of the above fair submission made by the learned Government Advocate, without going to the merits of the writ petition, this Court deems it appropriate to direct the respondents to consider the proposal forwarded by the 3rd respondent's dated 11.08.2023 in connection with the promotion of the petitioner according to its own merits and in accordance with law within a period of eight (8) weeks from the date of receipt of a copy of this order.
6. With the above observations, the Writ Petition stands disposed of. No costs.
