The petitioner, who is arrayed as sole accused, was arrested and remanded to judicial custody on 10.02.2016 for the alleged offences punishable under section 366 IPC read with Sections 5 and 6 of Protection of Children from Sexual Offence Act, 2012, in Crime No.200 of 2015 on the file of the respondent police and hence, seeks bail.

2. The case of the prosecution is that the daughter of the de-facto complainant is aged about 16 years and the accused kidnapped her on 21.05.2015 and thereafter had physical relationship and thereby she became pregnant and also delivered a child.

3. The learned counsel appearing for the petitioner submitted that the petitioner and the daughter of the de-facto complainant, namely, Brindha had fallen love with each other and on her own violation she joined with the petitioner, which was not liked by her parents and therefore, a false complaint

has been given against him. It is further submitted that the petitioner is ready to marry the K. KALYANA S U NDARAM, J .

vsg daughter of the de-facto complainant, namely, Brindha once she attains majority and the petitioner has also filed an affidavit of undertaking to that effect.

4. Heard the learned Government Advocate (Criminal side) appearing for the respondent.

5. Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner with certain conditions.

6. Accordingly, the petitioner is ordered to be released on bail on his executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Thiruchengode, and on further condition that the petitioner shall stay at report before the respondent police daily at 10.00 a.m., until further orders.
