M/s. T.Aswin Rajasimman For Respondent(s):
Mr.R.U.Dinesh Raj Kumar A.G.P., For R1 To R4
ORDER
By consent of both the learned counsel for the parties, the Writ Petition is taken up for final disposal, at the admission stage itself.
2. The instant writ petition has been filed with a prayer for issuing a Mandamus directing the first Respondent to re-engage the petitioner as Block Resource Person in the light of the order passed by the this Court in
W.P.Nos.19335 and 18552 of 2023, dated 29.08.2023 and the judgement passed by the Madurai Bench of this Court in W.A.(MD) No.1367 of 2024, dated 14.08.2024, within the time period stipulated by this Court.
3. The learned counsel for the petitioner submits that he has sent a representation dated 08.07.2025, seeking to re-engage the petitioner as a Block Resource Person, and such representation is pending with the first, third, and fourth respondents. He would further submit that the petitioner is entitled to reengagement as per the order in W.P. Nos. 19335 and 18552 of 2023, dated 29.08.2023, and the judgment passed by the Madurai Bench of this Court in W.A.(MD) No. 1367 of 2024, dated 14.08.2024. However, the respondents have not passed orders on the petitioner's representation.
4. At this juncture, the learned Additional Government Pleader appearing for the respondents would invite the attention of this Court to the order passed by the first respondent, vide order dated 28.04.2023, by and in which the petitioner's service was terminated. He would further submit that unless the
termination order is challenged, the question of considering the petitioner's representation does not arise.
5. I have given my anxious consideration to either side submissions.
6. Now that the petitioner wants his representation dated 08.07.2025, to be considered, and such representation has been pending with the respondents for quite some time, the contention of the learned Additional Government Pleader does have some bearing. The fact remains that the petitioner's representation is pending with the respondents.
7. In view of the above peculiar facts, without going into the merits of this Writ Petition, this Court deems it appropriate to direct the respondents to consider the petitioner's representation dated 08.07.2025, and pass orders on its own merits and in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.
8. With the above directions, this Writ Petition is disposed of. No costs. 05-08-2025 Index:Yes/No Speaking/Non-speaking order Internet:Yes kv To 1.The Director -SASTA Social Audit Society Of Tamil Nadu, Panagal Maaligai, West Saidapet, Chennai-600 015 2.The Joint Director (sr), Social Audit Society of Tamil Nadu, Chennai-600 015 3.The Additional Collector (Development) Project Director District Rural Development Agency, 4.The Assistant Director (Audit)
