The petitioners, who are arrayed as Accused, apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 294(b), 427, 506(ii) IPC and Section 3 & 4 of TNPPDL Act, on the file of the respondent police, in Crime No.199 of 2011 and seek anticipatory bail.

2. The case of the prosecution is that on 12.05.2011, the petitioners trespassed into the land of the defacto complainant and damaged the boundary stones.

3.The learned counsel for the petitioner would submit that the petitioners are innocent persons and they have been falsely implicated in this case. He further submitted that the petitioners are ready to cooperate for the trial.

4. The learned Government Advocate (Crl.side) appearing for the respondent would submit that the respondent police have completed the investigation and the charge sheet has also been filed before the learned Judicial Magistrate No.I, Namakkal, which is taken on file in P.R.C.No.4 of 2016.

5. Considering the above facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions.

Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate No.I, Namakkal and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and the petitioners shall appear before the trial court for all future hearings without fail. Except on those days her absence is condoned by filing a petition under Section 317 Cr.P.C. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

7.The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed. sms 28.03.2016 Crl.OP.No.6594 of 2016
