ORDER
This petition has been filed seeking to direct the Learned Judicial Magistrate No.II, Poonamallee to accept the surrender of the petitioner as authorized person on behalf of KCP Engineers PVT Ltd in Crime No.696 of 2019, pending investigation on the file of the Respondent police.
2.The person, who is entitled to file an application seeking for return of the vehicle would be an authorized person https://hcservices.ecourts.gov.in/hcservices/
representing KCP Engineers PVT Ltd. Since the company is a private limited company, such an authorization would be by the delegation of powers by the Board of Directors. While that being so, the petitioner herein is permitted to produce a duly authorised minutes of the Board Meeting authorizing the individual to file an application seeking for return of the vehicle. If such an application is filed before the concerned Court, the Court shall entertain the application and pass appropriate orders on its own merits and in accordance with law. 3.With the light of the above observations, this Criminal Original Petition stands closed.
