This Application has been filed under Sections 7 and 86 of Presidency Town Insolvency Act, 1909 to set aside the order dated 29.09.2023 passed by the Official Assignee rejecting claim petition No. 69 of 2015 in I.P.No. 25 of 2014.

2. In the affidavit filed in support of the Claim Petition, it had been contended that the applicant had filed Claim Petition No. 66 of 2015 for a total sum of Rs.16,50,000/- on the basis of the promissory notes. The applicant had filed claim petition for a total sum of Rs.16,50,000/-.

3. In the order of the Official Assignee, it had been stated that no documentary evidence had been produced to prove consideration for the promissory notes.

4. A notice was sent to the claimant, but which had been returned as unclaimed. The bank statement was produced by the applicant which do not reflect any entry relating to transfer of money to the account of the insolvent.
