Mu.A3/956/2025 dated 04.04.2025 , consequently restrain the 5th respondent from in any manner using the village Road of Hastinapuram for carrying their heavy mining trucks in deviation to the route permit issued and prevent the permanent damages to the road in the village and pass such further orders as this Honble Court.

ORDER

This Writ Petition has been filed to direct the 3rd respondent to conduct the enquiry pursuant to the proceedings of the 2nd respondent in Oo. Mu.A3/956/2025 dated 04.04.2025 , consequently restrain the 5th respondent from in any manner using the village Road of Hastinapuram for carrying their heavy mining trucks in deviation to the route permit issued and prevent the permanent damages to the road in the village.

2. On perusal of the records reveals that the petitioner submitted a representation before the 3rd respondent to restrain the 5th respondent from operating their heavy mining trucks through the village road of Hastinapuram. This prayer cannot be considered for the reason that the 5th respondent owns the vehicles and plys them with valid permits, and is legally permitted to transport mined materials from the quarry. If the 5th respondent violates the

terms and conditions of the permit, the 2nd respondent may take action against the 5th respondent in accordance with law.

3. With the above observations and directions, this Writ Petition is disposed of. Consequently, connected miscellaneous petition is closed. No costs.
