... Respondent PRAYER : Criminal Original Petition filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, to enlarge the Petitioner/Accused on bail in S.C. No.305 of 2015 on the file of the learned II Additional District Judge, Salem. For Petitioner :

O R D E R

The petitioner, who was arrested and remanded to judicial custody on 26.05.2025, for the offence punishable under Sections 147, 364, 302 r/w 149 of IPC in S.C. No.305 of 2015 on the file of the respondent. 1/4

2. The case of the prosecution is that petitioner was arrested on 26.05.2025 for the aforesaid offences, based on the NBW issued on 07.11.2024. The petitioner was originally granted bail. However, for breach of bond, twelve NBW's have been issued against the petitioner and was remanded to Judicial custody on 26.05.2025. Hence, the case.

3. The learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) strongly opposed for grant of bail to the petitioner stating that the petitioner has been absenting himself during the committal proceedings and the trial has been completed and almost 70% of the witnesses have been examined. The case is now posted on 07.08.2025 for examination of L.W.26 to L.W.29 and one more witness is to be examined.

5. Considering the fact that the case is pending from the year 2015 and also that the trial was almost completed, this Court is not inclined to grant bail to the 2/4

petitioner.

6. Accordingly, this Criminal Original Petition is dismissed. 01.08.2025 rap To

1. Inspector of police, Karipatty Police Station, Salem District.
