The present Civil Miscellaneous Petition has been filed to condone the delay of 54 days in filing the restoration petition in A.S.No.703 of 1997, which was dismissed for default on 06.04.2022 by this Court.

2. The learned Counsel appearing for both sides are present in Court.

3. Being satisfied with the reasons stated in the affidavit filed in support of this petition, upon hearing the learned Counsels appearing on either side and considering the nature of the suit, the delay of 54 days in filing the restoration petition in A.S.No.703 of 1997 is condoned and this Civil Miscellaneous Petition is ordered accordingly.

4. The learned Counsel appearing for both sides are directed to prosecute the appeal in A.S.No.703 of 1997 at the earnest without seeking any adjournment.
