The petitioner, who is the sole accused, was arrested and remanded to judicial custody on 23.02.2016 for the alleged offence punishable under Section 174 of Cr.P.C and subsequently altered into Section 306 of IPC, in Crime No.542 of 2015 on the file of the respondent police and hence, seeks bail 2.The case of the prosecution is that the petitioner got married the deceased on 29.02.2010 and they are having a son aged about 3-1/2 years and it is the second marriage for both of them. Since the accused did not take care of his wife and son, the deceased committed suicide by self immolation on 04.09.2015.

3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case and he has not committed any such offence as alleged by the prosecution. He further submitted that due to matrimonial dispute, the wife of the accused committed suicide and even as per the report of the Revenue Divisional Officer there was no dowry harassment.

4. The learned Government Advocate [Criminal Side] appearing for the respondent submitted that the petitioner has married the deceased in the year,2010 and they are having one son and the deceased committed suicide by self immolation due to the reason that the petitioner has not taken care of her.

rrg 5.Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner, with certain conditions. 6.Accordingly, the petitioner is ordered to be released on bail on his executing a personal bond for a sum of Rs.10,000/- [Rupees Ten Thousand only] with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.II, Vellore, and on further condition that the petitioner shall report before the respondent police daily twice at morning 10.00 a.m. and evening 5.30 p.m., until further orders.
