O R D E R

The petitioner has come forward with this petition seeking for a direction, directing the respondent to register the petitioner's complaint dated 10.02.2016 and to investigate the same.

2.The learned counsel appearing for the petitioner submitted that the petitioner purchased the property on 30.10.1995 from one Ragu. When he visited the said property, he came to know that the counter petitioner has impersonated and sold the property to one Krishnamoorthy. Even though the complaint was given by the petitioner on 10.02.2016, the respondent has not shown any interest to investigate the matter and to register the case. Hence, the petitioner has come up with the present petition for the relief as stated above.

3.The learned Additional Public Prosecutor appearing for the respondent submitted that on receipt of the complaint given by the petitioner, the respondent has forwarded the same to the Assistant Superintendent of Police, Hosur, to enquire the matter.

Considering the submissions made on both sides, the the Assistant Superintendent of Police, Hosur, is directed to nominate an Officer to enquire the matter and follow the dictum laid down in Lalitha Kumari vs. Govt. of U.P & others [2013 (4) Crimes 243 (SC) and register a case, if any cognizable offence is made out.

The Criminal Original Petition is disposed of with the above direction.
