ORDER
This Criminal Original Petition has been filed to direct the learned Sessions Judge, Special Court for the Exclusive Trial of POCSO Act cases, Chennai to dispose of the case in Spl.S.C.No.23 of 2021. 1/4
2.The learned Counsel appearing for the petitioner submitted that the petitioner had lodged a complaint against the father of the victim/accused and the same was registered in Crime No.6 of 2020 for the offences punishable under Sections 341, 328, 506(ii) of IPC, Section 75 of Juvenile Justice Act and Section 6 of Protection of Children from Sexual Offences (Amendment) Act, 2019 and the case was taken on file by the learned Sessions Judge, Special Court for the Exclusive Trial of POCSO Act cases, Chennai in Spl.S.C.No.23 of 2021. The case is pending from 24.02.2021 without any progress. Hence, the present petition has been filed.
3. I have considered the matter in the light of the submissions made by the learned counsel for the petitioner and perused the materials available on record.
4. On perusal of the records, it appears that the case has been protracted from 24.02.2021 without any valid reasons and now, the case has been posted for issuance of summons to LW1 to LW3 by 05.12.2022 and LW4 to LW10 by 06.12.2022 and LW11 to LW13 by 07.12.2022. It is seen that the Trial Court fixed date to examine the witnesses periodically. Thereby, the 2/4
learned Sessions Judge, Special Court for the Exclusive Trial of POCSO Act cases, Chennai is directed to complete the trial and dispose of the case in Spl.S.C.No.23 of 2021 within a period of three months from the date of receipt of a copy of this order.
5.With the above direction, this Criminal Original Petition stands disposed of.
