Mohan, (5) Easurajan, S/o.Iyyavu for the offence of molestation, outraged the women modesty in the public and attack on the petitioner's abdomen and caused heavy pain and bleeding, against the offenders (6) Sankar (7)Panchacharam and four unknown accomplices from Vedapalayam Village who have committed offences of broken the door of the petitioner house, criminal trespass, ransacking the household articles and damaging the same and looted money at a sum of Rs.30,000/- from almirah at petitioner's home. The petitioner has come forward with this petition seeking for a direction, directing the respondent to register a case on the basis of the complaint given by the petitioner on 15.02.2016.
2. The learned counsel for the petitioners submitted that the petitioner has given a complaint to the respondent as early as on 15.02.2016, but, however, the respondent police had not taken any steps to register a case and hence, the petitioner has come forward with this petition for the above stated relief. https://hcservices.ecourts.gov.in/hcservices/
3. At this juncture, the learned Additional Public Prosecutor, on instructions, would submit that based on the complaint given by the petitioner in C.S.R.No.85/2016, petition enquiry is going on.
4. Considering the rival submission made on both sides, the respondent is directed to expedite the enquiry and follow the dictum laid down in Lalitha Kumari vs. Govt. of U.P & others [2013 (4) Crimes 243 (SC) and register a case, if any cognizable offence is made out.
5. The Criminal Original Petition is disposed of with the above direction.
